Terms of Service

Effective January 1, 2026

These Terms of Service ("Terms") govern your access to and use of LeakClock (the "Service"), operated by IBEX Solutions LLC ("LeakClock", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

LeakClock is a record-keeping and compliance-management tool for HVAC-R businesses. It helps you track refrigerant-containing appliances, run leak-rate calculations, manage repair deadlines, and generate audit records under applicable EPA regulations (including 40 CFR §84.106 and §82.157).

Not legal or compliance advice. LeakClock is an information and record-keeping tool only. It is not a substitute for the regulation text, professional judgment, or legal counsel, and it does not guarantee compliance. You are responsible for meeting your own regulatory obligations. LeakClock is not affiliated with, endorsed by, or acting on behalf of the U.S. Environmental Protection Agency.

2. Accounts

  • You must provide accurate information and keep your login credentials secure.
  • You're responsible for all activity under your account and for your team members' use.
  • You must be at least 18 and authorized to bind your business to these Terms.

3. Subscriptions & billing

  • Paid plans are billed in advance on a recurring (monthly or annual) basis through our payment processor, Stripe.
  • New accounts may include a free trial; you won't be charged until the trial ends unless you subscribe earlier.
  • Subscriptions renew automatically until cancelled. You can cancel anytime; cancellation takes effect at the end of the current billing period.
  • Except where required by law, payments are non-refundable. We may issue refunds at our discretion.
  • We may change pricing with reasonable notice; changes apply to the next billing period.

4. Acceptable use

You agree not to misuse the Service — including reverse-engineering it, reselling it without permission, uploading unlawful content, attempting to breach security, or using it to violate any law. We may suspend accounts that do.

5. Your data

You own the data you enter. You grant us a limited license to store and process it to provide the Service. We handle personal data as described in our Privacy Policy. You can export your records at any time; on account deletion we remove your data within a reasonable period, subject to backups and legal requirements.

6. Availability

We work to keep the Service available but don't guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet every regulatory requirement or produce error-free results.

8. Limitation of liability

To the maximum extent permitted by law, LeakClock and IBEX Solutions LLC will not be liable for indirect, incidental, special, or consequential damages, or for regulatory fines, penalties, or lost profits, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or fail to pay. Sections that by their nature should survive (e.g., disclaimers, liability limits) survive termination.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you (e.g., by email or in-app). Continued use after changes take effect means you accept the revised Terms.
